UPDATE 3:35 p.m.: Lt. Murl Harpham of the Eureka Police Department responds to the “moments that deserve further explanation.” Plus, an apology from this reporter after the break.

Access Humboldt today posted this video, which shows footage from the rally that took place Monday outside the Eureka offices of Caltrans in protest of the planned road-widening project through Richardson Grove. According to the credits, the video was produced independently from the new activist coalition Redwood Grove Action Now! 

At least one anonymous commenter has claimed that police officers used Tasers during the event. Unfortunately, this 14-minute video does not provide conclusive evidence one way or the other, owing to the limited perspective, chaotic camerawork and the inexplicable dopey music bed that has been laid beneath the video.

There are, however, a few moments that deserve further explanation:

  • At 4:58 a protester being lifted by two officers, one holding each arm, suddenly goes limp.

  • At around 8:05 a protester who’s draped over a railing, surrounded by officers, seems to flinch. This is followed by a man’s shouts, and the shouts sound pained, though their source is indeterminate and the generalized yelling soon escalates, further confusing matters.

  • 8:35 — A woman starts screaming at the police officers. Much of it is indecipherable, though one line is clear: “Get that fuckin’ shit off his ankle right now!”

  • 9:00 — Protesters start chanting, “Shame!”

  • At about the 10-minute mark, officers start herding protesters away from the building, and at 10:15 you can see an officer holding what appears to be a Taser in his left hand. The moment is preceded by a few loud shouts/screams.

  • Shortly past the 11-minute mark, protesters, who have been locked out of the building, start pounding on the glass doors as officers inside drape yellow plastic over the glass, evidently to obscure the view. (Between 11:50 and 12:05, protesters can be heard encouraging a fellow activist to desist with the door-banging. “Stop! Nonviolent! Nonviolent!”)

Take a look for yourself and see if you spot anything else of note. 

UPDATE: In a phone conversation this afternoon, Lt. Murl Harpham of the Eureka Police Department responded to questions raised by the video.

Addressing the protester who goes limp, Harpham said, “That’s something they do — go limp so they have to be carried. That’s very typical. Some of ’em, a lot of times, are on drugs so they don’t feel much pain when you try to do pain compliance.”

Though he was present throughout the rally, Harpham did not see the moment at 8:05 when a protester seems to flinch (and he couldn’t get the video to work on his computer) so he could not respond specifically. Regarding the screaming he said simply, “There was a lot of screaming going on.”

Regarding the woman screaming about “his ankle” Harpham explained that officers were applying nunchucks to a protester’s ankle to stop him from kicking them. [And here I need to apologize to an anonymous commenter: In the story about the rally that appears in this week’s print edition of the Journal I expressed skepticism about the claim of nunchuck usage. Shows what I know.]

Harpham said the man was repeatedly kicking officers. “I was one of the ones he kicked,” he said. He explained that the nunchuck technique works as follows: “Wrap ’em around like a handcuff, then squeeze, which causes pain. … . That’s the way you get ’em to quit kickin’ ya. And there’s nothin’ damaging.”

Harpham acknowledged that it’s possible one of his fellow officers unsheathed his Taser but that he’s positive none was actually used. The devices are programmed, he explained, to report when they were last used and for how long, and none of their Tasers were activated Monday.

Regarding the plastic that was draped over the windows Harpham said that it’s a technique commonly used in law enforcement to reduce screaming and yelling. Asked about people’s right to see what was happening he said no such right exists. Once the protesters are deemed to be tresspassing (among other potential crimes), it becomes a crime scene and officers can order everyone, media included, to leave the scene, Harpham said.

In closing, Harpham said that two women protesters approached an EPD sergeant as the events of the day were calming down and told him they didn’t want the demonstration to turn out the way it did, that it had been taken over by members of Redwood Curtain CopWatch.

Oh, and he called back while I was writing this post to respond to Jeff Muskrat’s comment below: “The only sparks flying was when the grinder ground the arm bars [inside the lobby].” And he added that the EPD has two videos showing a protester hurling a full coffee cup at officers. We’ll post that as well when and if it’s made available.

    From what I understand, a gentleman was tased in the back by a cop. His uncontrolled reaction from getting shocked made him spill his coffee on a cop.

    Three people were tased, one my friend. No wait, they are all my friends…

  2. PS. The only kicking and trampling came from the cops. Watch the Access Humboldt video and see for yourself. They kicked and trampled us while we were locked down. In fact, those sadistic fucks took every opportunity to knock into us, knee us, kick us and trample us. I had my neck u-locked to the rail, I could have had my neck broken. These actions by the cops are inexcusable and reckless. Nothing new there…

    It’s in the video, Ryan, you need to adjust you screen or settings. I’m not sure why you are choosing to miss these highlights. You should watch it again…

    The gentleman who was getting attacked with the nunchuck weilding cops(2) along with one cop pinning him with his knee was singled out. We watched this transpire. We watched the cops plan it before it even happened. I was sitting right across from him. I won’t share his name…

    He was the most uncomfortable, the smallest by size and weight and most importantly, he was a person of color. You can watch him(the peaceful and smiling guy locked down, with the glasses) getting leaned back by one officer, then the officer puts his knee and full weight down on his chest. Two other officers proceed to apply pain compliance measures using two sets of nunchucks on his legs. Then the chants of “Shame” start.

    Shame on EPD. Again, the issue with the EPD is something else that isn’t really that new or unknown by the public…

I realize it’s off topic but someone should look into the fact that the State of Ca just (today) DECERTIFIED Humboldt Counties Housing Element, This jeopardizes over $70,000,000 in grant funding and truows the entire General Plan into a tailspin. It is also exactly what HumCPR, Realtors, FOL, Help, and dozens of others have been warning would happen if Kirk Girard was allowed to continue to spin his lies. BTW, Jimmy, Mark, and Clif all voted for the decertified plan after being told it was BS. Now back to Richardson Grove.

  8. It looked like some of those protesters were out of control. Have they never heard of a peaceful protest? If this was one then the profanity wouldn’t have taken place. Find more constructive words to express yourself to law enforcement. I, for one, don’t trust the cops, but they behaved professionally in this video.

    I was sitting right next to my friend (and yes he is peaceful and smiling most of the time) when he was singled out by EPD/CHP officers as the person they chose to apply pain compliance techniques to — Because he is young, male, a person of color, and the smallest male in the group. They thought if they applied enough pain he’d unlock himself, but he didn’t — even though one cop had his ankle and then his calf locked hard in the nunchucks, while ANOTHER cop kneed his neck. I was right up in the action at this point, with my face right in the nunchuck wielding cop’s butt as he towered over my friend.

    And you can quote me as saying “get that fucking shit off his ankle right now!” because it was impossible to just sit and watch my friend being brutalized. yeah, maybe that makes me verbally violent but it doesnt even compare to what we witnessed the EPD and CHP do to nonviolent people.

    For the record NO ONE INVOLVED IN THE PROTEST WAS ON DRUGS. Yes, the pain techniques hurt. They are afraid to admit that WE ARE STRONG. I have many bruises and soreness and stiffness all over my body. The going limp is a technique used, mostly so the cops can’t say we are fighting back at them, which would only make them hurt us more.

    Jeff is not narcisistic. The cops are sadistic. They are willing to hurt people and lock people up in order to protect corporate interests. By supporting the people running the CalTrans project they are knowingly aiding in the destruction of the natural earth systems and sustainable ways of living.

    That protest did nothing to save trees. It served only to let people dump their frustrations on the police, anger them who in turn angered the protesters. I suggest to the protesters that they do a MUCH better job of organizing, framing their protest (It’s not about big corporations or police) get real facts and figures, personal reasons why, etc. What I saw on that video likely did more harm to the trees then help.

  17. There was local media inside the lobby during the action and arrests. His name is Josh Jackson and he is a photojournalist for the Times Standard. You can clearly see him in the video taking pictures up until the police removed all individuals from the lobby that were not locked down. His phone number is: 441-0535. I wonder what he (and his camera) saw transpire between the police and the protesters? Those photos may just help the judge, jury and public make a decision about what really happened if the photos were released.

  30. Joel, you have been around long enough to know that participating in a discussion on a blog does not imply agreement, necessarily.

    In fact, quite often the opposite is true, when people agree, they tend to be silent, and will weigh in when they vehemently disagree. Those are the threads that generate the most comments.

    And, most of the time, while one may participate in a given thread, the conversation ebbs and flows, one will IGNORE certain inflammatory comments rather than engage in a flame war or give them life, and go on with some other facet of the discussion.

    Local political blogging is probably the most brutal in the nation. It is like knife-fighting in close quarters. I tell most people to stay out of the sandbox, (like the cliche?) because they cannot take the viciousness of it. My friends from out of the area are mystified when they come upon it, they’ve never seen anything like this.

    It seems you would prefer that The Herald be the only one of its kind, with no Mirror to present another side. Or SoHum to be the only political commentary, no dissenting voices allowed.

    I’m surprised, since you are famous for your clever posters (the paper kind) attacking the former President. One would think you would appreciate one’s right to express their views.

  35. I only speak for myself. I support the widening of US 101 though Richardson Grove. I drove the Avenue of the Giants today, old US 101, and many tree roots were cut and even the sides of some trees were cut into which are healing over and the trees are still living. Save the Redwoods League does not oppose this project, California Fish and Game does not oppose this project, the State Parks does not oppose this project. A poll conducted by KIEM showed 70% of respondents support, 27% oppose and 3% undecided the last time I checked. So for civility no name calling is required by anyone that disagrees with other peoples opinions. I for one support the project and I only speak for myself and have read the arguments put forth by those that do not support this project. Their opinions have not swayed my opinion though. Freedom of speech is what keeps us moving forward in a civilized society, and I hope this project starts moving forward this Summer.
