
She didn’t know it at the time, but last September was when everything started to unravel for Julie Hansen. It was late in the month when the furloughed Disneyland candy maker noticed a string of suspicious charges totaling $12,222.23 on her state-issued Bank of America unemployment debit card. First, the money was credited back to her account. Then it disappeared again, setting in motion a chain of events that left her and her son homeless.
Behind the scenes, California’s Employment Development Department and longtime debit card contractor Bank of America were scrambling to rein in rampant fraud. They froze some 350,000 unemployment accounts around the time Hansen’s card was cut off.
The catch: while Hansen and other out-of-work Californians were left in financial purgatory unable to access unemployment money, a Great Recession-era contract ensured that the state and the bank kept raking in millions of dollars in merchant fees whenever debit cards still in circulation were swiped.
In September, the EDD made $5.2 million on a debit card revenue sharing agreement with Bank of America — a sizable chunk of the $22.5 million the state raked in from March to October, according to public records requested by CalMatters. How much money did Bank of America make on its end of the deal?
The state says it doesn’t know, and the bank won’t say, despite a contract requirement to report unemployment debit card fees and revenue each month.
“EDD does not track BofA’s revenue,” the agency told CalMatters.
The bank declined to comment on its unemployment revenue and financial reporting.
“This is essentially a nifty little hidden kickback scheme,” said Assemblymember Jim Patterson, a Republican from Fresno. “This is becoming far too familiar. EDD just does not tell us what’s going on.”
Basic questions unanswered
In recent weeks, California lawmakers rushing to introduce new unemployment reform bills have struggled to get basic questions answered about when and how jobless workers are paid — and who profits in the process.
Under Bank of America’s exclusive 2010 unemployment debit card contract with the state, which was first detailed by CalMatters, the Employment Development Department does not pay the bank directly for its financial services. Instead, the two parties split revenue on merchant transaction fees when the cards are swiped, and the bank charges limited consumer fees for things like ATM use or rush shipping on new debit cards.
The contract specifies only that the state’s share of the fee revenue will “assist in offsetting program costs.” The bank was supposed to report at least monthly on any fees earned and its average revenue, according to the contract provided by the state. But when CalMatters asked for those reports, the state said it did not have any records on bank fees.
The agency said only that Bank of America made $37.8 million in transaction fees during 2013 — a figure disclosed as part of a bond estimate in a year when California paid out a sliver of the record $111 billion in unemployment benefits from March to December last year.
“I’m stunned that EDD doesn’t know,” Patterson said, “and I’m not sure that I believe that they don’t know.”
Bank of America said it suspended some consumer fees, including rush shipping charges, in the spring. The bank declined to comment on transaction fees.
Faiz Ahmad, managing director of transaction services for Bank of America, told lawmakers last week that despite any money the bank may have made during the pandemic, it “lost hundreds of millions of dollars on the contract” last year due to fraud and a need to hire more customer service workers to respond to complaints.
“Bank of America’s contract with EDD belongs to California’s taxpayers,” said Assemblymember Wendy Carrillo, a Democrat from Los Angeles. “Its contents are not secret. They belong to the public record.”
Lauren Saunders, associate director of the National Consumer Law Center, has studied unemployment debit card contracts including the one Bank of America has in California. She found that many states are “not paying any attention” to fees earned by banks — a lack of transparency that makes it hard to know how much unemployed workers are paying to use their benefit money — but that California’s revenue sharing agreement appears to be unique.
“Banks have to make money. They are selling a product,” Saunders said. “What’s more unusual is the state making money. That’s because California is such a big market and there was so much interchange revenue that the bank was willing to share some with the state, but that money should go back into making sure that people aren’t paying fees and to making sure that people get the money where they want to get it.”
A long fight
As fall turned to winter, Hansen tried everything she could think of to get her missing unemployment money back. She spent hours on hold with the bank, then called the state when she was told it was an identity verification issue. After waiting hours longer to get through to the state agency, and often hung up on in the process, she was told that she needed to call the bank.
She called politicians and posted online, and briefly saw the account reopened just long enough for another $672 to post to the account, only to have the card frozen again.
By December, it was too late. Hansen and her son slept in her Fiat or stayed with friends after they were forced to leave their two-bedroom rental in the Inland Empire to avoid eviction proceedings. There were no Christmas presents that month.

Stories like Hansen’s, where both the state and the bank have added to confusion, make the prospect of unraveling California’s unemployment crisis more daunting.
In Sacramento, both Democrats and Republicans have proposed legislation to add a direct deposit option for claimants, crack down on fraud and strengthen oversight. Bank of America’s current contract ends this summer.
In addition to refunding legitimate unemployment claimants caught up in the mess, Patterson worries about tax bills and unsuspecting people asked to repay the government for benefits paid out to fraudsters. He said lawmakers are weighing requirements for the agency to act fast.
Meanwhile, unemployment claimants accused Bank of America in a class-action lawsuit filed last month of putting them at risk of debit card fraud. The bank argues that the “vast majority” of fraud during the pandemic involved fraudulent unemployment applications that the state failed to catch, rather than debit card fraud.
While lawmakers and the state auditor press for more details on up to $31 billion in total fraud, Saunders said it’s also possible that federal watchdogs like the Consumer Financial Protection Bureau could get involved if the bank fails to provide claim documentation or timely credits for fraud as required by law.
“If they’re found not to have complied,” Saunders said, “then the bank would be responsible to reimburse the consumers.”
With no full reopening in sight for Disneyland, Hansen has taken to making boxes of toffee, chocolate strawberries and peanut brittle in a friend’s kitchen for anyone who still has $10 or $20 to spend.
She was mailed one paper unemployment check for $1,000 in January — enough to pay for her son’s medication and the car they were living in — and the family recently moved into a rented room while she fights for the rest of the missing money.
Hansen says, “There’s gotta be an easier way.”

The political system essentially involves two established conservative and (neo)liberal parties more or less alternating in governance while habitually kowtowing to the interests of the very wealthy but especially big businesss crippling threats (whether implied or explicit) of a loss of jobs, capital investment and/or economic stability, etcetera.
This of course fails to mention, amongst other things, the corporate-welfare-cheque subsidies doled out annually to already very profitable corporations and the forgiveness of huge loan debts owed to taxpayers.
This corporate-political reality may be why so many low-income citizens have felt futility in voting at all, let alone waiting in a long line-up in the weather to do so.

BOA aka Bank Of Fraud needs to be sued I had money stolen from my account as well and had no clue until it was time for me to pay some bills they locked my card back in October without warning so I called them and they said it was EDD problem I said that’s a lie so I asked to speak to a supervisor she was able to unlock my card that’s when I discovered money was stolen so I contacted fraud they sent me a new card but months later they closed my account and they finally credit my money back in January 2021 but my account is still closed my identity was proven as well but once again they lied and said EDD didn’t do it these people are putting others through a lot of stress for no reason I want and need my money just like everyone else I’m still able to verify for weekly benefits from EDD so Bank of America is lying I do believe that EDD is to blame as well however majority of it is Bank of Americas fault I have read articles about them owning money to the FDIC and etc they are fraudulent all around
They closed rural offices a few years ago. Should be called Bank of Urban America. I transfer my funds mostly to my credit union. What they should do is support local banks, but that would be less corrupt and more logical to support mainstreet as opposed to lamestreet. I actually got my first credit card when they cashed a check they shouldn’t have and offered me credit line with the debt from the money I already spent. A friend of mine also had this identity BS, even though completing all the protocols they asked for to verify identity. They just turned her card on when she finally got through EDD after 40 tries. The prompt sucks too with 2 mins of crap before it tells you there are no representatives available. I also know a guy who was on EDD before COVID-19 who is currently not getting anything due to this odd complication, clearly not a pandemic scammer. Scandalous.

Same thing happened to me. When you get someone on the line, there’s literally nothing they can do but hear you bitch. They say, no supervisors are available. And just wait and call back in a couple of weeks. Why have phone representatives that can’t do jack shit. Don’t understand.
They are asking me to pay back my unemployment stimulus funds I received…from $8,600 for 14 weeks they want back $6,100…so I only get around $1,300 for the year of unemployment… something IS very wrong.

This is why we transfer the funds from our Bank of America card to our checking account as soon as the money is available. We sre suffering while they are cashing in on fees! 8 weeks waiting for payment.
I will never use BoA ever again! I remember back in 2012-2013 when I was using California EDD through unemployment. When you use your card with BoA. I went in and stood in a long line. When it was my turn, I asked for my balance as I wanted to get some cash back but instead I was stunned that they made me go to the outside ATM to check my balance, (which btw cost me $5.00), then bring the receipt in to show them in order to check the balance, then get cash! They treated me like trash! If you read this article then you can put two and two together and realize why they are doing that to make money with EDD and off of the unemployed! Only BoA has the EDD Card Contract as you can see and definitely someone is up to no good. Stealing innocent out of work peoples hard earned tax money out of their low paid unemployment checks! I hope and pray the BoA Heads go to prison for keeping these peoples checks and causing them traumatic injuries due to placing them in deeper poverty! That poor woman and her son. I think BoA is up to more weird stuff with the cards, too. I applied for CalFresh, but was denied because of some weird way that the calculations are done that resulted in them saying I had more money to spend on food in a month than I had reported making.
But the odd thing is, I still got a B of A issued EBT card, just with 0 money and $0 in benefits on it. And I couldn’t figure out what was going on – why waste time and money putting my name and account number on an empty card?
But now that I read this, I have to wonder whether B of A has something to gain by sending out debit cards to people who aren’t going to get benefits….
I’ve been dealing with the EDD and Bank of America also since charges were also done on my account, I caught them because at the same time I lost my card so it stopped the fraudsters to take more. I didn’t realize I lost money for 3weeks and filed my complaint, BofA gave me my money back and a couple months go by to end of September, the BofA froze my account. I called the agent directed me to call a special number for EDD and the EDD stated it was done for identity issues and that I was good on their end. She directed me to contact BofA back to the Risk department. I did and the risk department tells me October5th my account will be reopened. On October 8th however, the freeze generated a fraud alert to my account which generated a reversal on my dispute and $1,376 was taken out of my account putting me $1000 negative. I called the bank and they acknowledge their error and stated it would be returned and they had no timeline to give me when. I called every week about it for 3 more weeks until finally another agent states I have to request to reopen my complaint and file another complaint against the closure. Also to send in a statement of facts, any information I have about the claim and to file a police report. I followed their direction and faxed in proof, still 5 weeks more nothing . Then the EDD freeze my account again with a notice to send them ID. Then email me that they will be setting up a process to Identify myself on Jan 6th which will be how I send proof. So I waited and nothing was available to do so until 8th. But I sent emails to EDD about my issues everytime I checked with no response except they received my requests. Finally I had to reopen by reapplying for UIB back to 4/5/20. Then I was given a link to ID.me I did that and was put into Referee need. I logged in for one with a over 5 hour wait for over 10 days. Finally got thru on Jan 23rd and went to post the ID link to my account and EDD UI site was down until Sunday morning So the link posted Sunday. Wed I received a notice that I am disqualified for UIB due to non-compliance of ID proof. That generated a permanent reversal of my fraud claim on BofA. Are you kidding. And I have to file appeal to get my UIB back. Not to mention the money they already gave me shows $0.00 on my 1099 so I can’t file taxes to get my stimulus check or earned income either. This put me on the streets again. Seriously bullshit.

Edd and b of a in cohoots on this one for sure. After receiving 12,000 in benefit payments I was flagged for identity, i won appeal, during the weeks I had no income I was forced to move out of state, edd had my address, I tried to pull money out of BofA atm and found my card had been suspended not by edd but by bank of America they needed edd to send electronic notifications proving I get benefits, edd rep told me she did it that everything should be fine. I come to find now bofa and edd are in cahoots because now I’m again needing to prove my identity after winning an appeal, 2 months later my identity is verified still I have no access to my funds now I’m told it’s going to another department at edd…. I asked since my identity is ok can they release funds I have been paid for still nothing. I dont know what do do anymore.

Edd verification department at 1800-240-8100 is the problem. They not only avoid or not answer their calls they only “work” from 8-12 noon. I’ve uploaded verified even have receipt/reference for my identity in which they confirmed with me. All Edd has to do is send my verification over to BofA’s risk department and BofA verifies my identity and they will unlock my account. BofA is waiting for the EDD employees to get off their asses and work! EDD has the balls to mention on the automated system something like “we’ve ramped up our team to help answer high call volume due to Covid-19” but out of 300 times I called seems like I’ll get like 2 live person from Edd. At least with BofA 10 out of 10 times they answer. Dont know if they’re telling or giving me the truth but their service is a lot better than Edd. Red Flag everywhere all over for Edd!!! What fucking shame! And wtf are guys smashing on BofA more than Edd their the problem!
I have done everything that the EDD has told me to do so I can verify my ID. It took almost 90 days to get that taken care of then i went on my extension got paid one week then got a email suspected fraud but how i my verification done and that was 7 going on 8 weeks now just to get told to resend prof of my ID and i have but i stil get NO HELP none from any one my family is suffering i had my car impounded because i could not get my funds to get repairs done i am demoralized and i still have no help and i still see NO END to my night mair and feel like the only thing i can do now is take my own life so that way the EDD can say they WIN BECAUSE I AM DONE
So sorry for all you people who have gone through so many hoops to get what is rightfully yours. It is a shame. I’ve learned a bit from the article and from the comments. All I can advise is that you pray that God stops the evil that greed creates. And that He punishes those involved in earning off of people’s misfortune. A class action lawsuit against the state/bank is probably the next course of action but possibly reaching out to your state representative, congressman, and Senator’s will have an impact and Will assist you in getting a resolution to your individual cases. Im a victim of this scam also 🤬 It started on October 27,2020 $980 was taken from my account in Brooklyn NY at a BofA i was told. I closed the account and got a new card. A couple of weeks later the new card got cut off and i haven’t recieved anything since but the blame game of who did it. Bank Robbers of America & EDD need to be held accountable for this
Same issue with me. Somebody hacked my account and stole $1,000 from me last month, I reported it right away and froze my account. Give had no money to survive with since December and they are all making me feel like the criminal while they made me homeless too. There has to be something we can do about this BS.
Hello, My name is Zenea I have wonderful news for anyone that this has happened too. On 09/29/2020 my card was cut off as well still cut off to this day. But because I’m a fighter I found the person that his talking all of my money from my edd card and also off of my unemployment and DI 300,000 stating edd took it it all bs. I have his numbers emails also on recordings he is a tax advocate that works for the unemployment office also is working very close with EDD Bank of America back office in the claims department and they are all working with risk Department everything that I’m telling you I have paperwork to prove it this is why people cards are being cut off they’re saying that the state cut your card off come to find out it is risk supervisors that is telling people cards off on October 4th 2020 on a Sunday at 8:45pm. Someone in the risk open my card and someone in the back office in claims at edd bof manually reverse $39,000 out of my account all paperwork to prove it I have all recordings to prove it
I dont know if anyone is aware of this, but I am the payee for my minor son. His money comes on a US direct express debit card and its what SSI funds are loaded onto. Strange tho no other money can be loaded onto it even tho its a debit card. But everytime the card is used fees are charged and guess who has their contract? yep you guessed it….b of a!! So they have these contracts with more than one card, or agency. They make money off of ssi recipients too!

I am extremely sorry for everyone that is going through this process with EDD or BOA. I just want to shed some light and possibly some hope. My Acct was hacked by ATM in Nov I called BOA and reported the situation right away they filed a claim and canceled my old card, sent me a new one. Well everything seem to be going smooth until I called BOA and my Claim was closed the next day with out notice! I asked the representative why? She couldnt give me a clear answer so I asked for a Supervisor the supervisor was helpful she explained that the system flagged my claim due to the type of claim that it was?? Okay what does that mean?? She continued explaining that due to the tremendous amount of FRAUD that is happening with ATMs the system flags these types of claims and now I have to submit a reconsideration to get my claim reopened and investigated once the claim is open they have approximately 90 days to investigate Thats when the time starts, She than stated to send in a police report, statement and a picture of my ID. I did I waited a month nothing I called my reconsideration was never submitted!!! I than had to resubmit one!! They received my faxs another reconsideration was submitted and I received my money at the end of Jan. So what I recommend is dont give up call them make sure they submit the reconsideration and if in doubt ask for a supervisor they seem to know more than the regular agents. Wish you all best of luck also I opened a checking acct with another bank and I transfer my funds to that acct once they hit my prepaid card I havent had any issues. Stop using the prepaid card. This is why I get so upset when having to deal with These companies that are sold to us as Our much needed defence against that mass of cleverly disguised mass of evolving evil. When the truth of the matter is, There’s no disguise required. It’s a group of people with their bay area offices located within the protection of razor wires and state paid guards at all times. Their choice is Scott Peterson I believe, and one of their top money market whiz kids goes by the same name he used to collect his unemployment last year, Poopy pants. And I have to deal with 48 hours and 32 minutes of hold time since Friday at 7:30 in the morning. 8 different 5 hour plus sessions with only 1 ending in a 4 minute video chat.
There shouldn’t be a wall of defences keeping people away from money they have been paying into over the years. There isn’t a single person in this entire state they can explain to me why I have not been able to at least have 3 minutes additional face time with a company that is supposed to be In their current position as a protection against fraud. There is no possible way I should be watching a timer go from nearly 6 hours down to 0 and have someone on the other side just put me back in at the end of the 6 hour wait again With the flick of a switch. What those additional 7 people didn’t realize is the very 1st one had shown me on my tablet while I video chatted with him, on my phone, exactly what document was needed the following time. So a picture of my phone bill Was the only thing standing between me and an additional 40 hours of hold time. I finally got ahold of someone at our own unemployment office who walked me through the verification process without needing this additional company. I realise there’s fraud that occurs and costs the state money. I just can’t help but Feel like most of The slight of hand and misdirection used by great magicians, is easier to catch when there isn’t all the congestion constantly flowing throughout the stage and surrounding pockets of smoke and mirrors.
