I find this appalling and terribly discouraging. The point of the negotiated settlement, in which the dollar damages were reduced by 90%, was to protect the residents by requiring outside monitoring. I spoke with California Advocates for Nursing Home Reform, and was told that attorneys suing nursing homes in the future are going to make sure their settlement agreements cover subsequent managers, but that is cold comfort to the residents in the facilities owned by Skilled Healthcare.
