Sgt. Wayne Hanson misstated the law. Under Cal. Health & Safety Code Sec. 11488.4(i) the government has the burden of proof in all forfeiture cases. If there is a related criminal case the statute requires the forfeiture case to be tried with the criminal case, in a bifurcated proceeding. If the head guy in this task force doesn't know the law, what does that mean for the quality of law enforcement? It's a good thing that the community is discussing forfeiture laws, but this article doesn't begin to explain what is wrong with, and corrupting about the forfeiture laws.
