After discussing the situation with Nunes, Glass said he didn’t see a problem with considering a variance for the Shanty and other Eureka bars with outdoor patios, provided employees, customers and neighbors aren’t subjected to unwanted smoke. “If you’re making a conscious decision to go into the smoking garden … that isn’t where we were targeting,” Glass said. Councilmembers Linda Atkins and Jeff Leonard agreed, telling the Journal they’d be willing to consider exceptions to the regulations as long as no one’s health is being jeopardized against his or her will. “We’ll just have to go through the process of getting it on our agenda for an amendment and [another] public hearing,” Atkins said. I’m not a smoker, and personally can’t stand tobacco smoke, but a separate smoking garden at a bar, where you have to be 21 to enter, should definitely be exempt from this. We’re not children, I just stay inside the non-smoking part of the bar when I go to the Shanty. Geez.

If you care, show up and comment at the next council meeting, instead of just bitching about the council trying to protect their constituents from an obviously very real health issue. Larry’s the most responsive and real council member you’ll ever find, anywhere. Did you read what he said? He’s willing to vote to change it, and the council realizes it made a small mistake.
