1. An Agriculture Preserve & Lot Line Adjustment application, Case Nos. AGP-07-04 & LLA-07-25; LORI HANSEN, applicant; File Nos. APN 310-043-03, 310-051-01 & 310-051-02; Loleta area. An application to establish approximately 21 acres into a Class D Agricultural Preserve pursuant to the California Land Conservation Act (otherwise known as the Williamson Act) and the Humboldt County Agricultural Preserve Guidelines. In order to facilitate the establishment of the preserve, a Lot Line Adjustment is needed to move approximately 19 acres from Parcel A (currently 139 acres) and add to Parcel B (currently 1.5 acres). This action will reduce the existing Hansen Class C Agriculture Preserve (established by Resolution No. 82-23) from 139 acres to 120 acres. A Coastal Development Permit is being processed by the California Coastal Commission, necessary for final execution of the Lot Line Adjustment. THE PROJECT SITE IS LOCATED IN HUMBOLDT COUNTY, IN THE LOLETA AREA, ON THE NORTH SIDE OF CANNIBAL ROAD, APPROXIMATELY 1,289 FEET NORTHWEST FROM THE INTERSECTION OF COCK ROBIN ISLAND ROAD AND CANNIBAL ROAD, ON THE PROPERTIES KNOWN TO BE IN SECTIONS 10 AND 15 TOWNSHIP 3 NORTH RANGE 2 WEST. NOTE: This project is located within the Coastal Zone.NOTE: On October 2, 2008, the Humboldt County Planning Commission adopted Resolution #08-099 recommending that the Humboldt County Board of Supervisors approve the Agriculture Preserve and Lot Line Adjustment applications.

2. A General Plan Amendment, Zone Reclassification & Lot Line Adjustment application; Case Nos. GPA-08-01, ZR-08-02 & LLA-08-25; GRETCHEN HOWARD; applicant; File Nos. APN 405-111-03 & 405-121-08; Freshwater area. A General Plan Amendment to Timber Production (T) and a Zone Reclassification to Timberland Production Zone (TPZ) in order to facilitate a Lot Line Adjustment of approximately 0.7 acre into the adjacent 76.9 acres that is planned and zoned for timber production. The area to be adjusted is not developed, and, per letter from Able Forestry Consultants, the area is fully stocked with Redwood timber and meets the inclusion requirements into TPZ. The Lot Line Adjustment will result in Parcels 1 and 2 of approximately 8.54 and 77.6 acres, respectively. The Lot Line Adjustment will remedy the creation of parcels in violation of subdivision regulations and provide the adjacent property access at the end of Howard Heights Road to facilitate timber operations. THE PROJECT SITE IS LOCATED IN HUMBOLDT COUNTY, IN THE FRESHWATER AREA, ON THE PROPERTY KNOWN AS 540 HOWARD HEIGHTS ROAD AND THE PROPERTY KNOWN TO BE IN SECTION 4 TOWNSHIP 4 NORTH RANGE 1 EAST.NOTE: On November 6, 2008, the Humboldt County Planning Commission adopted Resolution #08-116 and recommended that the Humboldt County Board of Supervisors adopt the General Plan Amendment, Zone Reclassification and approve the Lot Line Adjustment applications.

3. An Agriculture Preserve & Zone Reclassification application, Case Nos. AGP-07-05, ZR-07-06, DS-07-41 & NOM-07-31; ANDY AND SANDY WESTFALL, applicants; File Nos. APN 311-021-09, 311-041-30 & 311-041-34; Elk River area. An application to establish approximately 77 acres into a Class C Agricultural Preserve pursuant to the California Land Conservation Act (otherwise known as the Williamson Act) and the Humboldt County Agricultural Preserve Guidelines. In order to facilitate the establishment of the Agricultural Preserve, a Notice of Merger is required to merge a substandard 1.7 acre parcel into the larger agricultural unit and a Zone Reclassification to rezone lands zoned Agriculture General, 10 acre minimum (AG-B5(10)) to Agriculture Exclusive (AE). A petition to rezone approximately 20 acres zoned Agriculture General, 10 acre minimum (AG-B5(10)) to Timberland Production Zone (TPZ) has been requested as a part of the establishment of the preserve. THE PROJECT SITE IS LOCATED IN HUMBOLDT COUNTY, IN THE ELK RIVER AREA, ON THE WEST SIDE OF ELK RIVER ROAD AND WRIGLEY ROAD, ON THE PROPERTY KNOWN AS 8224 ELK RIVER ROAD AND THE PROPERTIES KNOWN TO BE IN SECTION 26 TOWNSHIP 04 NORTH RANGE 01 WEST.NOTE: On September 18, 2008, the Humboldt County Planning Commission adopted Resolution #08-102 recommending that the Humboldt County Board of Supervisors approve the Agriculture Preserve, Zone Reclassification, Determination of Status and Notice of Merger applications.

4. Addition of land to existing Agricultural Preserve #87-28 application, Case Nos. AGP-07-01; JACK AND LINDA RUSS, applicants; File Nos. APN 100-142-10, and portion of 100-143-05 and -06; Ferndale area. The addition of 44.7 acres of agricultural land to Agricultural Preserve #87-28 (Centerville Ranch Preserve) and lands under Williamson Act Contract. A proposal to enlarge the boundary of an existing agricultural preserve requires a public hearing pursuant to Section 51231 of the California Government Code. The parcel is currently vacant. An associated Lot Line Adjustment and Coastal Development Permit (Case Nos. A Local Coastal Plan Amendment, Zone Reclassification & Coastal Development Permit application, Case Nos. GPA-07-02, ZR-07-07 & CDP-07-67 (filed 5/8/08); NEW HEART COMMUNITY CHURCH, applicant; File No. APN 511-401-39; McKinleyville area. A Local Coastal Plan Amendment and Zone Reclassification to change the Local Coastal Plan land use map and zoning designations from Commercial Recreation (CR) to Public Facility (PF) to enable construction of a church. Also, a Coastal Development Permit for future construction of the church is requested, contingent on the Plan and Zone change. The public interest requirement for the Plan and Zone change is proposed to be satisfied by granting an easement for construction of the last segment of the Hammond Trail, a public multi-use trail.

The church will be constructed in Phases. The first phase is the construction of the Hammond Trail along the east side of the property, which was completed under a separate Coastal Development Permit in 2007. The other phases will be construction of a main auditorium, offices, meeting rooms, a kitchen, and a lobby. The building will be approximately 42,000 square feet in size and will be a maximum of 35 feet in height. There are 248 proposed parking spaces. The parcel is served by public water and sewer, and a public road (Murray Road) which is paved to a width of 30 feet in front of the property. THE PROJECT SITE IS LOCATED IN HUMBOLDT COUNTY, IN THE McKINLEYVILLE AREA, ON THE PROPERTY KNOWN AS 899 MURRAY ROAD. NOTE: On October 16, 2008, the Humboldt County Planning Commission recommended that the Humboldt County Board of Supervisors adopt the General Plan Amendment and Zone Reclassification and approve the Coastal Development Permit.

1. A Final Map Subdivision application, Case No. FMS-05-14; CLAUDE & LILLIAN PERRAS, applicants; File No. APN 203-201-39; Fortuna area. The Major Subdivision of an approximate 5.34 acre parcel into two (2) parcels. Both resultant parcels will be approximately 2.67 acres. Proposed Parcel 1 is developed with a single family residence (approximately 3,000 square feet in size). Proposed Parcel 2 is developed with a manufactured home, a shop, garage and storage building. The parcels are served by on-site septic systems. The City of Fortuna currently provides water service for two residences. Although this project seeks to create only two parcels, it must be processed as a Final Map Subdivision given that the applicant was the subdivider of the subject parcel as well as the adjacent parcels. The project is found to be exempt from Solar Shading as each resultant lot exceeds one (1) acre in size and the lot configuration does not limit solar access. 2. An Extension of a Final Map Subdivision application, Case No. FMS-05-03X; PACIFIC SUNSET DEVELOPMENT, applicant; File No. APN 511-431-62; McKinleyville area. A two year extension of a Major Subdivision approved on June 15, 2006. The original project involved the major subdivision of an approximate two (2) acre parcel into eleven (11) lots ranging in size from 6,500 to 10,800 square feet. The property is currently developed with a mobilehome and barn which will be removed. The request for an exception to the lot frontage requirement for the creation of flag lots was granted with the original approval. The parcel is and will be served by McKinleyville Community Services District. The only change is the relocation of the proposed offsite drainage easement onto Assessor Parcel Numbers (APN) 511-431-49 (Mattos) and 511-431-50 (Dunmire), rather than over the more northerly parcel, APN 511-431-34 (Steinberg). The Planning Division has found this substitution to be in substantial conformance with the terms of then original project approval. If approved, the extension will expire on June 27, 2010. THE PROJECT SITE IS LOCATED IN HUMBOLDT COUNTY, IN THE McKINLEYVILLE AREA, ON THE PROPERTY KNOWN AS 3078 McKINLEYVILLE AVENUE. 3. A Modification to a Coastal Development Permit application, Case No. CDP-99-42M; STEVE MOSER, applicant; File Nos. APN 511-471-01, 511-471-03, 511-471-04, 511-471-08, 511-471-09, 511-471-11, 511-471-12, 511-471-13, 511-471-16, 511-471-17, 511-471-18, 511-471-19, 511-471-20, 511-471-21, 511-471-24, 511-471-25, 511-471-26, 511-471-27, 511-471-28, 511-471-30, 511-471-31, 511-471-32, 511-471-33, 511-471-36 & 511-471-37; McKinleyville area. A Modification to an approved blanket Coastal Development Permit associated with the Sande Pointe subdivision, recorded December 13, 2001 as Tract 533 in Book 23, pages 6 through 9. All parcels will be served by public sewer and water. The original project included a blanket Coastal Development Permit for the development of one single family dwelling each on lots 1 through 37. To date, twelve, (12) of the lots have been developed and twenty-five (25) are currently vacant. The blanket Coastal Development Permit is valid for seven years following the recordation of the tract map and is therefore due to expire on December 13, 2008. This Modification seeks to change the blanket permit validation period from seven (7) years to fourteen (14) years. If approved, the modified blanket Coastal Development Permit will expire on December 13, 2015. This Modification makes no other changes to the previously approved blanket Coastal Development. As previously approved, Lots 1 through 8, 13, 22 through 29 and 34 through 37 are limited to a maximum of 23 feet. All other lots have a 35 foot height limitation as allowed by the zone. 1. A Parcel Map Subdivision & Special Permit application, Case Nos. PMS-08-02, & SP-08-09; NICK FRANK, applicant; File No. APN 303-071-07; Eureka area. A Minor Subdivision of an approximate 31,911 square foot parcel into four (4) parcels. The subject parcel is developed with legal non-conforming residences. Upon approval of the subdivision, all of the residences will be situated on separate, legal parcels and conform to all zoning regulations including setbacks. Proposed Parcel 1 will be approximately 5,683 square feet (net) and is developed with a single residence and an attached secondary dwelling unit currently being rebuilt due to fire damage. The rebuild is being processed under Building Permit Number 08-0831B2. Proposed Parcel 2 will be approximately 9,018 square feet (net) and is developed with a single family residence and an attached secondary dwelling unit. Proposed Parcel 3 will be approximately 7,562 square feet (net) and is developed with a single family residence. Proposed Parcel 4 will be approximately 5,791 square feet (net) and is currently vacant. Besides improvements associated with the subdivision and the rebuild mentioned above, no new development is proposed at this time. Minimal grading is anticipated and one tree, within the proposed access road right of way, is proposed to be removed as a part of this project. Water and sewer services are provided by the Humboldt Community Services District. A Special Permit is required for an exception to the minimum lot size requirement per Humboldt County Zoning Code Section 314-99.1.2 for proposed Parcels 1 and 4 and for the secondary dwelling unit on Proposed Parcel 1. The secondary unit on Proposed Parcel 2 is principally permitted.The applicant has also requested approval of an exception to allow for a reduced frontage for Proposed Parcel 1 and Proposed Parcel 3 as well as an exception to the right of way width requirement per Sections 325-9 of the Subdivision Regulations. THE PROJECT SITE IS LOCATED IN HUMBOLDT COUNTY, IN THE EUREKA AREA, ON THE PROPERTY KNOWN AS 6188 AVALON DRIVE. NOTE: The Humboldt County Planning Commission intends to adopt a Mitigated Negative Declaration of Environmental Impact for this project.

2. A Modification to a Conditional Use Permit, Surface Mining Permit & Reclamation Plan application, Case Nos. CUP-02-19M, SMP-02-02M & RP-02-02M; LADD ASSOCIATES, applicant; File Nos. APN 207-181-16, 207-181-19 & 207-182-09; Bridgeville area. A Modification to an approved Conditional Use/Surface Mining Permits, Reclamation Plan and financial assurance cost estimates for surface mining operation permitted in 2005. The hard rock quarry is located 1.5 miles southwest of Bridgeville. The Modification proposes an increase in the annual amount of rock to be mined from 20,000 to 100,000 tons with the actual amount depending upon demand. No other changes to the approved project are proposed, and the Modification does not affect the current 15 year permit term to expire in 2020.

The site is surrounded by timberlands and ranch lands. The Van Duzen River is located a half mile to the north and 1,000 feet lower than the site. Access to the site is via a private road that connects to Alderpoint Road and that crosses Hoaglund Creek and an unnamed intermittent creek, both of which are tributaries of the Van Duzen River. Minor improvements, e.g. grading and widening, have been made to the access road under the original permit approval. The site currently consists of a large sandstone outcrop, and the commodity to be mined is rip rap rock for commercial use. The issues to be considered at the hearing include, but are not limited to, health and safety issues, including noise, road safety, traffic, and impacts to environmental resources. The quarry operation will involve extraction, processing, stockpiling, and transporting. The projected frequency of operations will be up to several times a year for periods ranging from a few days to a few weeks with the majority of mining operations to take place in the drier months. Most of the time, the quarry would be inactive. Explosives and mechanical means will be used to harvest rock. Typically, blasting will not occur more than once or twice a week, and then only when the mine is in an active mode. Equipment to be used include drills, bulldozers, excavators, crushers, screens, loaders and trucks. The project site is within an Agricultural Preserve. THE PROJECT SITE IS LOCATED IN HUMBOLDT COUNTY, IN THE BRIDGEVILLE AREA, ON THE PROPERTY KNOWN AS 47400 ALDERPOINT ROAD. NOTE: The Humboldt County Planning Commission intends to adopt a Mitigated Negative Declaration of Environmental Impact for this project.

3. A Conditional Use Permit, Surface Mining Permit & Reclamation Plan application, Case Nos. CUP-06-30, SMP-06-01 & RP-06-01; KENNETH AND MEREDITH WALLAN, applicants; File Nos. APN 223-136-03 & 223-136-04; Garberville area. Approval of Conditional Use/Surface Mining Permits, Reclamation Plan and Financial Cost Estimates for the Wallan Quarry, previously known as the Monschke Quarry, with a 15 year permit term. The site has been intermittently quarried since at least 1963 for major highway construction projects, riverbank flood repair and bridge abutment protection. The quarry was previously permitted in 1989 (CUP-21-89/SMR-01-89). The project proposes continued operations for the intermittent extraction and processing of up to 45,000 cubic yards in any given year with an average annual rate not to exceed 15,000 cubic yards.

Since the 1989 approval, approximately 70,000 cubic yards of material has been removed from the site and utilized for highway construction and rip rap. The current project proposes a project limit of nine acres with the proposed quarry area of 3.5 acres containing approximately 190,000 cubic yards of massive greywacke with minor amounts of shale and greenstone. Quarry material will be used for jetty rock, highway construction projects, rip rap, erosion control and rock-slope protection. The issues to be considered at the hearing include, but are not limited to, health and safety issues, including noise, road safety, traffic, asbestos, and impacts to environmental resources.

Operations will primarily involve drilling and blasting and excavation, on-site road and staging area improvements, on-site storage of rock, sorting, loading and hauling by truck, erosion control and incidental and final reclamation. Final reclamation includes final grading, drainage improvements, restoration of surface soils and revegetation. THE PROJECT SITE IS LOCATED IN HUMBOLDT COUNTY, IN THE GARBERVILLE AREA, ON THE NORTH SIDE OF ALDERPOINT ROAD, APPROXIMATELY 1.10 MILES NORTHEAST FROM THE INTERSECTION OF U.S. HIGHWAY 101 AND ALDERPOINT ROAD, ON THE PROPERTIES KNOWN TO BE IN SECTION 18 TOWNSHIP 04 SOUTH RANGE 04 EAST.NOTE: The Humboldt County Planning Commission intends to adopt a Mitigated Negative Declaration of Environmental Impact for this project.
