In the unlikely event that PacifiCorp somehow obtained a renewed 401 certification from the California Water Board, then the death knell for them obtaining a renewed FERC license is the Section 18 prescriptions that will be imposed by the federal fisheries agencies. Both have already indicated through a biological opinion that they would prescribe both upstream and downstream fish passage requirements for ALL life stages of not only Salmonids, but Pacific Lamprey. Those are some incredibly costly fish ladder improvements to implement! PacifiCorp knows this, which is why they will most likely surrender thier FERC license.
Fred, Your point shows one of the reasons why the deal is so important. Leaving management of the Basin subject to the annual vagaries of strong/weak fish runs, anticipated snow pack, ESA, BuRec, etc. has led to continued conflict rather than trusted flow levels for both Upper and Lower Basin users.
